Welcome to Canvas Ateliers! These Terms and Conditions (“Terms”) govern your access to and use of our website (canvasateliers.nl) and our services including participation in any art workshops or courses offered by Canvas Ateliers. By using our site or signing up for our workshops, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, please refrain from using our services.
1. Definitions and Scope
- Canvas Ateliers / “we” / “us” – refers to Canvas Ateliers V.O.F., a creative workshops studio based in Amsterdam, Netherlands (KVK 98922394).
- Services – refers to the artistic workshops, courses, events, and related services offered by Canvas Ateliers, both public workshops and privately booked sessions.
- User / “you” – refers to any individual or entity visiting our website or participating in our services (workshop attendees, website visitors, customers, etc.).
- Private Event – a workshop session booked exclusively for a group (such as corporate team events or private parties) not open to the general public schedule.
These Terms apply to all bookings and participation in Canvas Ateliers workshops, as well as to use of our website. Additional conditions may apply for specific private event agreements – in case of any conflict, the specific signed agreement for a private event will take precedence for that event.
2. Workshop Registration and Payment
To enroll in a Canvas Ateliers workshop (open session or private booking), you must provide accurate information during registration and pay the required fee.
- Booking Process: You can book an open workshop through our online system (e.g., via our Shopify ticketing checkout). For private group workshops, bookings are typically made by contacting us through our private booking form or email, after which we will provide a proposal or invoice.
- Information Needed: When registering, you will be asked for basic personal details (name, contact info) and payment details. You agree to provide accurate and current information. This data will be handled according to our Privacy Policy (see above).
- Payment: For public workshops, payment is due in full at the time of booking to reserve your spot. For private events, payment terms (such as a deposit amount and due date for the balance) will be specified in your booking agreement. If a deposit is required, your booking is confirmed only after the deposit is paid by the deadline given. Failure to pay on time may result in cancellation of the reservation.
- Confirmation: Once your payment is completed, we will send a confirmation (via email) of your booking. This confirms your entitlement to attend the specified workshop. Please check the details in the confirmation and contact us if anything is incorrect.
3. Prices and Taxes
All prices for workshops are listed in Euros (€) and are inclusive of any applicable VAT (Dutch sales tax) unless stated otherwise. We reserve the right to adjust pricing for future workshops or special events, but once you have booked and paid for a workshop, your price is locked in. Any promotional offers or discounts must be applied at the time of booking – we cannot retroactively apply discounts to completed bookings.
4. Cancellation, Refunds & Transfers
By booking a workshop, you agree to our cancellation and refund policy outlined in the Refund & Cancellation Policy section above, which is incorporated into these Terms. Below is a brief summary:
- If you need to cancel your attendance at an open workshop, please let us know at least 72 hours in advance for a full refund. Partial refunds or no refunds will apply for later cancellations (see Refund Policy for details). No-shows will not be refunded.
- Private event bookings are subject to their own cancellation terms, typically requiring around one week’s notice for any refund (cancellations with short notice may forfeit fees). Refer to your specific agreement for the exact terms.
- We allow rescheduling of a booking in some cases if you cannot attend, provided you contact us timely (generally 48+ hours for open workshops to switch to a future session, if available). Rescheduling of private events will depend on availability and adequate notice (usually at least 5 days prior). Late reschedule requests may be treated as cancellations.
- Canvas Ateliers reserves the right to cancel or reschedule a workshop if necessary (e.g., if minimum enrollment numbers are not met, or due to unforeseen issues). If we cancel an event you’ve paid for, you will have the choice of a full refund or credit towards another workshop. We are not liable for additional costs you incur (such as travel or accommodation) due to our cancellation; our liability to you in such cases is limited to the refund of the workshop fee.
All cancellation or change requests should be sent in writing to info@canvasateliers.nl so we have an official record.
5. Workshop Participation and Conduct
Our workshops are designed to be a positive, creative experience for all participants. By attending, you agree to conduct yourself respectfully and adhere to any rules or instructions given by the instructors:
- Arrival: Please arrive on time for workshops. We recommend coming 5-10 minutes early to settle in. Late arrivals may miss important instructions and in some cases might not be allowed to join if they arrive too late, to avoid disruption (no refunds for late/no arrival).
- Age Requirements: Canvas Ateliers workshops are generally suitable for adults. Minors under 18 are welcome only if accompanied by a parent or legal guardian, or with explicit permission (for example, a signed consent). Some workshops may involve tools or materials not suitable for young children. It is the responsibility of parents/guardians to supervise minors and ensure the workshop is appropriate for them.
- Health & Safety: We prioritize a safe and comfortable environment. Participants must follow any safety guidelines explained by the instructor (for example, proper use of tools, not ingesting art materials, etc.). If you have any medical or allergy concerns (e.g., sensitivity to certain art supplies or foods provided), please inform us in advance and take appropriate precautions.
- Behavior: We reserve the right to refuse entry or eject any participant who is disruptive, intoxicated, or poses a risk to others or to the peaceful atmosphere of the workshop. Our workshops are meant to be friendly and inclusive; harassment, discrimination, or dangerous behavior will not be tolerated. If a participant is asked to leave for such reasons, they will not receive a refund.
- Materials: Unless otherwise specified, Canvas Ateliers provides all necessary art materials and tools for use during the workshop. Participants are expected to handle the art supplies and tools with care. You are responsible for your own personal belongings at the studio or event venue – we encourage you to keep valuables with you. Canvas Ateliers is not liable for any loss, theft, or damage of personal items during an event.
6. Artwork and Intellectual Property
- Your Artwork: Any artwork that you create during a Canvas Ateliers workshop is yours to keep. We encourage you to take your finished pieces home and proudly display them! We do not claim ownership over the art you make as a participant.
- Use of Workshop Content: The techniques, ideas, and lesson materials taught in our workshops are the intellectual property of Canvas Ateliers and/or our instructors. These are provided to you for your personal enjoyment and learning. We kindly ask that you do not replicate our workshops for commercial purposes or teach the same curriculum elsewhere without permission. (In short, you can absolutely use your new skills personally, but please don’t resell our workshop concept or materials as your own.)
- Photographs & Media: We love to document the creative fun of our workshops. By attending, you acknowledge that Canvas Ateliers may take photographs or short videos during the session, which might include images of participants and their artwork. We may use these photos/videos for promotional purposes on our website or social media, to show others what our events are like. We will not use your name or tag you without consent, and we aim to respect everyone’s comfort – if you prefer not to be photographed, please let us know at the start of the workshop, and we will accommodate. All such photos/videos taken by us remain our property. Participants are of course welcome to take pictures of their own artwork and experience, and share them (tag us @canvasateliers if you do!). However, please avoid capturing other attendees in your photos without their permission.
- Image & copyright note: Some reference images shown in our promotional materials (including flyers, mood boards, and inspiration examples) may be sourced from public platforms such as Pinterest and/or may be AI-generated. These images remain the intellectual property of their respective creators/rights holders and are used only for inspiration and example purposes. Canvas Ateliers does not claim ownership over third-party reference images. If you are a rights holder and would like content removed or credited differently, please contact us at info@canvasateliers.nl. All artworks created during our workshops are original and made by participants.
7. Liability Waiver
Canvas Ateliers will do everything reasonably possible to ensure you have a safe and enjoyable experience. However, by attending our workshops or accessing our services, you agree to the following:
- Assumption of Risk: You understand that participating in art workshops may involve some inherent risks (for example, exposure to paints, sharp crafting tools like scissors or needles, etc.). You agree to assume all risks of any injuries or damages that may occur during or as a result of participating in our workshops, to the extent permitted by law.
- Release of Liability: Canvas Ateliers and its owners, partners, instructors, and agents shall not be held responsible for any personal injury, illness, damage, or loss of property that may occur before, during, or after any workshop session, except in cases of gross negligence or willful misconduct. Participants attend and partake in the activities at their own risk. We encourage you to follow instructions and exercise care, especially when using any tools or materials.
- Indemnification: You agree to indemnify and hold harmless Canvas Ateliers and its staff from any claims, liabilities, damages, or expenses (including reasonable attorney’s fees) arising from your own actions or omissions during the workshop or use of our website. (Simply put, this means if you do something to cause harm or violate these Terms, you can’t hold us responsible, and if your action causes us to incur damage or costs, you may be responsible for those.)
Nothing in these Terms seeks to limit any rights you have under consumer protection laws or other statutory rights that cannot be waived. The above is just to clarify that our liability is limited in reasonable ways and that we expect participants to take responsibility for personal safety and common sense while enjoying our events.
8. Changes or Cancellations by Canvas Ateliers
We strive to run all workshops as scheduled. However, we reserve the right to change or cancel events in certain circumstances:
- Minimum Enrollment: Many workshops require a minimum number of participants to create a good group experience. If too few people sign up, we may postpone or cancel that session. We’ll inform you at least 24 hours in advance in such cases and issue you a full refund or option to reschedule.
- Unforeseen Events: If an instructor becomes unavailable due to illness, or if there is an emergency (e.g., extreme weather, venue issues), we might have to reschedule or cancel on short notice. We will notify you via email and/or phone as soon as possible.
- Venue Changes: Occasionally, we might change the workshop venue (for example, to a larger space to accommodate more people, or a different studio for a special event). We will inform you of any venue change ahead of time. The new venue will always be in the same general city/area (Amsterdam) and meet our quality standards.
- Your Options: In the event that we cancel or significantly change a workshop you’ve paid for, you are entitled to a full refund of the ticket price (or deposit) if you prefer. Alternatively, we may offer to transfer your booking to a new date or provide a credit for a future workshop – the choice is yours. We will work with you to find a satisfactory solution.
Canvas Ateliers is not liable for any additional compensation beyond the refund of the workshop fee in cases where we cancel or change an event. (For example, if you had travel or accommodation booked, those costs are your responsibility; we recommend if you’re coming from far, to choose flexible booking options.)
9. Website Use and Content
In addition to workshop-related terms, using our website (canvasateliers.nl) comes with its own set of expectations:
- Website Content: All content on our website – including text, images of artwork or events, logos, and design – is the intellectual property of Canvas Ateliers or our content suppliers. You may not reproduce or use our website content for commercial purposes without our explicit written permission. You are welcome to share our content on social media or personal blogs, as long as it is credited and not altered.
- User Conduct Online: When using any interactive parts of our site (such as posting a comment or contacting us through a form), you agree to use respectful language and provide truthful information. Do not attempt to introduce any malicious code, spam, or attack the integrity of our website. Any such misuse will result in termination of your right to use our site, and possibly legal action.
- External Links: Our website or communications may include links to third-party websites (for example, ticketing platforms or social media pages). These are provided for convenience. Canvas Ateliers is not responsible for the content or policies of those third-party sites. When you follow a link to an external site, you should review that site’s own terms and privacy policy.
10. Privacy
Please review our Privacy Policy (above) to understand how we collect and use personal data. By using our site or services, you agree that we can use your information in accordance with our Privacy Policy. If you have questions about your data, feel free to contact us at info@canvasateliers.nl.
11. Changes to Terms
Canvas Ateliers may update these Terms and Conditions from time to time. Reasons for changes may include updates to our services, changes in laws, or improvements in clarity. When we update terms, we will post the revised Terms on our website with a new effective date. For significant changes, we may also notify our registered users via email. Continued use of our website or attendance of workshops after changes are made constitutes acceptance of the new Terms. We encourage you to periodically review this page for the latest information.
12. Governing Law and Disputes
These Terms & Conditions, as well as any separate agreements whereby we provide you services (such as a private event contract), shall be governed by and construed in accordance with the laws of the Netherlands. This means that any dispute or claim arising out of these Terms or your use of our services will be resolved under Dutch law.
If a dispute arises, we kindly ask you to contact us first so we can try to resolve it amicably. We value our customers and will do our best to address any concerns. However, if we cannot reach a mutual solution, you agree that the courts of The Netherlands shall have jurisdiction to settle any matter. (As a consumer, you may also have the right under EU law to use the EU Online Dispute Resolution platform or other mediation channels; this does not limit any statutory rights.)
